Recent U.S. Supreme Court Decisions

Thornell v. Jones (May 30, 2024)

When a capital defendant claims that he was prejudiced at sentencing because counsel failed to present available mitigating evidence, a court must decide whether it is reasonably likely that the additional evidence would have avoided a death sentence. This requires considering the strength of all the evidence and comparing the weight of aggravating and mitigating factors.

Cantero v. Bank of America, N. A. (May 30, 2024)

A state law that regulates a national bank is preempted if the state law prevents or significantly interferes with the exercise by the national bank of its powers.

National Rifle Association of America v. Vullo (May 30, 2024)

The First Amendment prohibits government officials from wielding their power selectively to punish or suppress speech, including through private intermediaries.

Brown v. United States (May 23, 2024)

A state crime constitutes a “serious drug offense” for the purposes of the Armed Career Criminal Act if it involved a drug that was on the federal schedules when the defendant possessed or trafficked in it but was later removed.

Alexander v. South Carolina State Conference of the NAACP (May 23, 2024)

The evidentiary force of an alternative map in a redistricting case, coupled with its easy availability, means that trial courts should draw an adverse inference from a plaintiff's failure to submit this map.
