Christina Aguilera‘s boyfriend, Matthew Rutler, will reportedly not be charged with a DUI after he was arrested early last month for drunk driving in West Hollywood.
According to a report by TMZ, the Los Angeles County District Attorney will not charge Rutler with a DUI due to insufficient evidence that he was too drunk to drive. Rutler’s blood alcohol content at the time of his arrest on March 1 was determined to be .06; because California’s legal limit to drive a car is .08, Rutler will not be charged.
The L.A. County District Attorney’s office did not immediately respond to Billboard’s request for comment.

Christina Aguilera Arrested for Public Intoxication
Aguilera was a passenger in Rutler’s car at the time of the arrest, and deputies determined that the singer was “not capable of taking care of herself,” according to Sheriff’s Department representative Steve Whitmore. Aguilera was arrested on a misdemeanor public intoxication charge and released hours later; the Sheriff’s Department stated no desire to prosecute the singer.
Aguilera will next be seen on the April 26 premiere of “The Voice,” NBC’s singing competition in which she, Cee Lo Green, Adam Levine and Blake Shelton will serve as judges.
